The aim of the web site is to provide access to a range of our products / gifts for sale, provide information about our business and party plan model and any other services that we may offer.

To ensure a safe environment for all users, we have established these Terms and Conditions. In this way, you will know what you can expect from us, and what we can expect from you. Wicked Australia Pty. Ltd. reserves the right to:
2.1  change or remove (temporarily or permanently) the Website or any part of it without notice and you confirm that The Wicked Gift Store shall not be liable to you for any such change or removal and.
2.2  change these Terms and Conditions at any time, and your continued use of the Website following any changes shall be deemed to be your acceptance of such change.

5  Ordering & Price Structure

The products offered by The Wicked Gift Store (www.thewickedgiftstore.com.au) are subject to availability and may be withdrawn at any time. We reserve the right to refuse to accept an order request in whole or in part. We will process your order once you have registered and we have received your payment details.

The prices quoted by The Wicked Gift Store (www.thewickedgiftstore.com.au) are in Australian dollars (AUD) and are fully inclusive of government taxes (GST).

6  Payment Methods

The Wicked Gift Store (www.thewickedgiftstore.com.au) accepts most major credit cards such as Visa and Mastercard, via our secure online ordering system. This is the quickest and most reliable way to pay for your order. Credit cards are charged before the order is sent. The merchant name that will appear on your credit card statement is “The Wicked Gift Store”. Other payment methods such as, Direct Deposit, Money Order, Cheque or Business Account (Invoice) are at the sole discretion of management and staff of The Wicked Gift Store and have the right to refuse such payment methods.

7  Delivery Methods

The Wicked Gift Store offers deliveries to most major areas of Australia. A delivery is interpreted as an attempted delivery by us. We do not accept liability for delay in the event there is no-one to receive the delivery at the delivery address. All items purchased from The Wicked Gift Store are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

If the delivery details given by you are incorrect, and thus affecting delivery we may have to charge an additional delivery charge. Australia Post is our preferred method of delivery.

8 Refund Policy

The Wicked Gift Store (www.thewickedgiftstore.com.au) offers a fourteen (14) day money back guarantee on all of our products. If you believe a product does not conform to our specification in any way, or is defective, please contact us on 1300 787 491 to arrange return. We do not accept returns or offer refunds for a simple change of mind or incorrect choice.

9 Cancellation Policy

To cancel an order, please send an email detailing the transaction to sales@thewickedgiftstore.com.au  .If the order has not been shipped, the order will immediately be cancelled. Once an order has left our workshop for delivery it can no longer be cancelled. An administration fee of no more than $10.00 may be imposed for cancelled orders.

10 Disclaimers and Limitation of Liability

10.1  The Website is provided on an AS IS and AS AVAILABLE basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
10.2  To the extent permitted by law, Wicked Australia Pty. Ltd. will not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Website.
10.3  The Wicked Gift Store makes no warranty that the functionality of the Website will be uninterrupted or error free, that defects will be corrected or that the Website or the server that makes it available are free of viruses or anything else which may be harmful or destructive.

11 Product Disclaimer & General Warning

The Wicked Gift Store (www.thewickedgiftstore.com.au) only offers original products. Our Natural Soy Wax Candles & Alcohol Free Reed Diffusers are made by us in our workshop in Western Australia. All other giftware items have been hand chosen by us to compliment our products.

The Wicked Gift Store (www.thewickedgiftstore.com.au) attempts to be as accurate as possible. However, we do not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by The Wicked Gift Store (www.thewickedgiftstore.com.au) itself is not as described, your sole remedy is to contact us, informing us of the situation and to return it in unused condition.

Failure to follow instructions could result in fire, hazard or injury. never move a lit candle. Always keep out of reach from pets and children. Place the candle on a stable, heat resistant surface. Avoid exposure to drafts. Never leave a lit candle unattended. Avoid placing candle next to curtains or similar movable flammable furniture. Caution, container may become hot. At the end of combustion a variable quantity of wax may remain. Always store the candle in a cool and dry place. Below 25 degree/c.

To avoid spillage, trim the wick shorter, as the wall of the candle become thin.

12  Indemnity

You agree to indemnify and hold Wicked Australia Pty. Ltd. and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against Wicked Australia Pty. Ltd. arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this Website.

13  Severance

If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.

14  Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the state of Western Australia and you hereby submit to the exclusive jurisdiction of the Western Australian courts.
